New since 1 January 2026

Three zones: legal, misdemeanour, crime

Act No. 270/2025 changed the Czech Criminal Code. Adults aged 21 and over can now grow and keep a limited amount of cannabis for their own use. Above the limits, it becomes a misdemeanour, then a crime. Selling and any supply to others remain crimes.

  • Legal from age 21, for your own use only.
  • Misdemeanour: fine up to 50,000 CZK, and the plants or cannabis are taken.
  • Crime: up to 6 months in prison, and much more for large amounts.

Selling, giving, sharing

Still a crime, even between friends and even for free. Growing for someone else counts too.

Anyone under 18

Giving cannabis to a minor is a serious crime.

Aged 18 to 20

The legal limits only apply from 21. Under 21, having or growing cannabis can still be punished.

Driving

From 2 ng/ml of THC in blood: a fine of 7,000 to 25,000 CZK and a 6 to 18-month driving ban. Higher levels can be a crime.

Smoking in public

Not legalised: smoking bans still apply at stops, on public transport, in restaurants and near playgrounds.

Medical cannabis

Legal on prescription since 2013.

No shops, no clubs, no legal market: every sale of cannabis is still a crime in the Czech Republic. The reform only covers growing your own.

Help and harm reduction

  • Keep plants and cannabis out of sight and out of reach of children.
  • Never drive after using.
  • Avoid semi-synthetic products like HHC: their effects are unpredictable.
  • Start low and go slow, especially with edibles.
